Description:

Aim:
The purpose of this presentation is to familiarise family practitioners with applications under s 38(6) of the Children Act 1989.

Outcomes

By the end of this presentation you will:

1) Know the legal provisions relating to family assessments;
2) Know the case law relating to family assessments;
3) Understand the costs and funding implications of family assessments;
4) Know the different types of family assessments available, what to look for and how to prepare your client;
5) Know when and how to make an application for an order under s 38(6) of the Children Act 1989.

The presentation is aimed at beginner and intermediate practitioners who have a basic understanding of public law proceedings and have some experience of directions hearings and the Protocol.

Jacqui Gilliat

Jacqui Gilliatt is a family barrister, called in 1992, practising from 4 Brick Court, Chambers of Janet Mitchell, based in London. She has lectured and trained in family law topics including representing parents in care proceedings, cross-examination for social workers, advocacy in public law proceedings, contact, case management and s 38(6) assessments. She is a member of the FLBA.
