Aim
To explore the practical planning implications for private clients of the Budget proposals on 22 April, together with other recent developments in capital taxes.

Outcome
Solicitors will be able to give pro-active advice, with confidence, to their private clients on the implications of Budget 2009 on family fiscal matters.

    • Income Tax
    • Inheritance Tax
    • Capital Gains Tax and
    • Indirect Taxation
  • Agricultural Property Relief: comment on HMRC's 'Interim Guidance' released on 9 February 2009
  • Business Property Relief: 'mere assets' secure relief (Nelson Dance Family Trustees v HMRC), but grazing arrangements in Northern Ireland constituted a disqualifying investment (McCall and another as PRs of McClean deceased v HMRC)
  • Business Property Relief from holiday lettings: the practical application of HMRC's change of practice
  • SDLT and Stamp Duty: implications of (a) in specie contributions to pension funds and (b) transfers of interests in family property-investment partnerships
