From the 1st October 2007, the only option available for those who want to plan ahead for the onset of mental incapacity is the creation of a Lasting Power of Attorney. These are more complex and time consuming documents and as such, many professionals are concerned about drafting them, the advise they need to give and acting as the certificate provider.
Solicitors for the Elderly are offering members the opportunity to buy a training and resource package. This will assist members and their firms in coping with the new challenges, ensure that we do not use up valuable time to reinvent the wheel and establish best practice.
The following have already been sent to members free of charge:
A marketing leaflet on LPAs for member's firms to use. The content can be cut and pasted into the member's firm's house style.A marketing leaflet about acting as a certificate provider and the benefit of using an SFE member (this is on the SFE letter heading).

The training session comprises:
a CD, which members can listen to and Resources pack.
CD Contents
The first part involves a recording of an interview between a fictitious client and solicitor and the advice that needs to be given for taking instructions and drafting the LPA.
The second part will be where the client sees another solicitor to act as the certificate provider.
Resources Pack
The resources pack includes:
1. An instruction checklist for advisers to make sure they have advised on all important aspects of LPAs and for drafting purposes 2. A chart showing the benefits and drawbacks of delaying registration of LPA 3. A best interests checklist record sheet 4. A record of assessment of capacity sheet 5. A checklist for the certificate provider, which can be used along side the assessment record sheet. 6. A series of precedents drafted by Barrister, David Rees of 5 Stone Buildings. 7. Client care letter including explaining what needs to be brought to the interview and the importance of having named persons to notify of the registration. 8. Donor client information sheet 9. Information sheet for attorney's taking on the role
