European Union product liability legislation was enacted in the United Kingdom by the Consumer Protection Act 1988 which came into force on 1 March 1988. However, it is greatly under used. Many litigators do not recognise when a claim under the Act may arise. For example, there is a popular misconception that only “consumer products” can be the subject of a claim under the legislation.

Dai Davis who is not a litigator, but who is an expert in product liability, will explain the circumstances where a claim may be brought under the Act and the tactics that might be adopted.

He will cover:

  • the scope of the legislation
  • who may be sued
  • what loss and damage may be subject of a claim

The course is suitable for people with no or a passing knowledge of product safety, but also those with a more detailed knowledge. Dai will also refer to other, related, safety – specific legislation, such as the General Product Safety Legislation and the “CE Marking” legislation.

Dai Davis Dai is a Technology Lawyer. He read Physics at Keble College, Oxford and took a Masters Degree in Computing Science at the University of Newcastle-upon-Tyne before qualifying as a Solicitor. He is a qualified Chartered Engineer and Member of the Institution of Electrical Engineers. Dai is an active member of the Society for Computers and Law in the United Kingdom and has been Chairman of its Northern Branch and a member of the Council of that Society.

Dai is a full time consultant with national law firm Nabarro Nathanson where he is Head of IT Group (North). Dai advises clients on intellectual property, computer and technology law subjects including such topical matters as E-Commerce issues. He is primarily a non-contentious lawyer. He specialises in advising on commercial agreements relating to software and technology products as well as licensing agreements and general advice relating to intellectual property rights. He also has considerable experience advising companies and consultants on product liability and product safety issues. Dai is a regular contributor to legal and technology journals and is a panellist to the World E-Business Law Report.

Dai is a Fellow of the Royal Society for the encouragement of Arts, Manufactures and Commerce. Dai is the convenor of the International Electro-technical Committee TC56 - Legal Advisory Working Group (IEC TC56 being the organisation which is responsible for drafting international maintainability and dependability standards). Dai is a member of the Executive Committee of the IEE Professional Management Network and of the Council of the Licensing Executives Society.
